1. Acceptance of Terms

By accessing and using FitCutter ("the Service"), including the FitCutter website, Chrome extension, and related services, you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

FitCutter is a Chrome browser extension and web platform that enhances YouTube workout videos. The Service has two distinct user roles:

2.1 Viewers (Free)

The FitCutter Chrome extension is completely free for viewers. No account, sign-up, or payment is required. Viewers can:

  • Skip exercises on tagged workout videos that don't suit their body or needs
  • Customise rest times between exercises to match their fitness level
  • Filter exercises by available equipment
  • Schedule YouTube workout videos and track progress in daily, monthly, or yearly breakdowns with category tracking

All viewer preferences and selections are stored locally in the browser only and are never transmitted to our servers or shared with third parties.

2.2 Creators (Paid Subscription)

Fitness content creators can subscribe to FitCutter to tag and annotate their own YouTube workout videos. Creators use the extension's built-in controls within the YouTube player to mark rest zones, label movement types, and specify equipment for each video segment. These tags are then available to all viewers who have the FitCutter extension installed.

3. User Accounts and Authentication

3.1 Viewer Accounts

Viewers do not need an account. The extension works without sign-up or login.

3.2 Creator Accounts

To access creator features, you must create an account through the following process:

  • Sign in with your Google account via Google Sign-In
  • Authorise FitCutter to access read-only YouTube channel metadata (channel ID, channel name) - this is a one-time step during registration
  • Receive a unique passkey from the Creator Dashboard that links the Chrome extension to your account and YouTube channel

You are responsible for:

  • Maintaining the confidentiality of your passkey - anyone with it could tag videos on your behalf
  • All activities that occur under your account
  • Notifying us immediately of any unauthorised use of your account

You may regenerate your passkey at any time via the Creator Dashboard. When a new passkey is generated, the previous one becomes invalid immediately, but all tags created with the previous passkey continue to function.

4. Subscription and Payment Terms

The FitCutter Chrome extension is free for all viewers. Creator subscriptions are paid services.

4.1 Free Trial

New creator accounts receive a free 15-day trial. A credit card is required to start the trial via Paddle; you will not be charged until the trial period ends. During the trial, you have full access to all creator features. If you do not continue with a paid plan before the trial ends, your tags will be paused (not deleted) and will no longer be visible to viewers. You can restore them instantly at any time by subscribing to a paid plan.

4.2 Subscription Plans

FitCutter currently offers the following monthly creator plans:

  • Starter - $15/month: Tag up to 10 videos. Includes rest zone, movement, and equipment segment tagging with a channel-verified passkey.
  • Unlimited - $25/month: Unlimited video tagging with all features included.

All payments are processed by Paddle, which acts as the Merchant of Record for FitCutter transactions. Paddle handles billing, tax collection, and payment processing. Your credit card statement will show charges from "Paddle.com".

4.3 Automatic Renewal

Paid subscriptions renew automatically each month unless cancelled before the renewal date. You can cancel your subscription through the Paddle billing portal accessible from your payment receipt email.

4.4 Cancellation

You can cancel your creator subscription at any time. Upon cancellation:

  • You retain access to creator features until the end of your current paid period
  • After the paid period ends, your tags will be paused and hidden from viewers
  • Your tags and account data are retained - you can restore everything instantly by re-subscribing

4.5 Price Changes

We reserve the right to modify subscription pricing. We will provide at least 30 days' notice of any price changes, and changes will take effect at your next billing cycle.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Distribute malicious code, viruses, or harmful software
  • Attempt to gain unauthorised access to our systems, other user accounts, or other creators' passkeys
  • Tag or modify videos belonging to channels you do not own
  • Interfere with or disrupt the Service, servers, or the YouTube viewing experience
  • Use automated systems (bots, scrapers) to interact with the Service without explicit permission
  • Misrepresent your identity, channel ownership, or affiliation with any person or entity

6. Content and Intellectual Property

6.1 Your Content

As a creator, you retain all rights to the workout videos you create and tag. By using FitCutter's tagging tools, you grant us a limited, non-exclusive licence to store, process, and serve your workout annotations (rest zones, movement types, equipment tags, and timestamps) to provide the Service to viewers.

6.2 Channel Verification

FitCutter uses a multi-layer verification process to protect your content. During registration, you authorise read-only access to your YouTube channel metadata (channel ID and name). Your passkey is cryptographically linked to your account and channel. When you tag a video, the server verifies that your passkey belongs to the channel that owns the video. This ensures only verified channel owners can tag their own content.

6.3 Our Service

The Service, including its original content, features, and functionality, is owned by FitCutter and is protected by international copyright, trademark, and other intellectual property laws.

6.4 YouTube Content

FitCutter operates as a tool that enhances the YouTube viewing experience. It does not download, modify, or redistribute YouTube video content. All YouTube content accessed through the Service remains subject to YouTube's Terms of Service. We do not claim any rights to third-party content.

7. Creator Responsibilities

If you use FitCutter as a content creator, you agree to:

  • Only tag videos on YouTube channels you own and have verified through the registration process
  • Accurately tag rest zones, movement types, and equipment in your workout videos
  • Ensure you have the right to distribute the content you tag
  • Comply with YouTube's Terms of Service and Creator policies
  • Keep your passkey confidential and not share it with unauthorised third parties
  • Not use the Service to distribute misleading, harmful, or inappropriate fitness advice

8. Disclaimers and Limitation of Liability

8.1 "As-Is" Service

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2 Fitness Disclaimer

FitCutter is a tool for customizing workout videos and does not provide medical or fitness advice. Always consult with a healthcare professional before starting any new exercise program. You use workout content at your own risk.

8.3 Limitation of Liability

To the maximum extent permitted by law, FitCutter and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or similar that may be transmitted to or through the Service by any third party
  • Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Service

9. Indemnification

You agree to indemnify, defend, and hold harmless FitCutter, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

Upon termination by us, your tags will be removed and your right to use creator features will immediately cease. If you wish to end your subscription voluntarily, you may cancel through the Paddle billing portal (accessible via your payment receipt email). Your tags will be paused at the end of the current billing period and can be restored if you re-subscribe in the future.

11. Third-Party Services

The Service integrates with third-party services including:

  • YouTube: Subject to YouTube's Terms of Service
  • Google Sign-In: Subject to Google's Terms of Service
  • Paddle: Payment processing subject to Paddle's Terms

We are not responsible for the practices or content of these third-party services.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FitCutter operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the appropriate courts of that jurisdiction.
